Supreme Court And Attorney General Play Football With Case Against Somaliland’s Political Parties

Hargeysa, Somaliland, November 14, 2009 (SL Times) – A court case against Somaliland’s political parties was kicked back and forth between the attorney general and the Supreme Court. The case was filed against the political parties by a Somaliland citizen, Mr Mohamud Jama Ahmed, and it charges the parties of having committed crimes for which they should be liable.
Mohamud Jama Ahmed, a law student at the Two Niles University (Jamiat al-Nilayn), originally filed the case with the attorney general who passed it to the supreme court, which sent it back to the attorney general, who then declined to make any further moves on the case. The attorney general’s justification for not considering the case was that it did not fall within his duties to look at the case and that it was the duty of the Supreme Court to handle it. Similarly, the head of the supreme court Hirsi Ismail ( Oomane) said he is a judge and only considers cases that were referred to him, but he does not initiate cases against people, although he did concede that violations of the law did occur during the recent political crisis.
Mr. Mohamud Jama Ahmed is still committed to pushing for the case against the political parties. He accused the political parties of grave violations of the law during the last political crisis, and insisted that they should be accountable for their crimes, and no one should be above the law. He also appealed to Somaliland’s citizens to bring pressure to bear on the judicial system so they would take the case, otherwise, the political parties will continue in their actions that violate the law and endanger the lives of citizens. For him, it is a matter of principle.
